Abstract

The election of regional heads is a form of people's political participation in a democratic country, so the cleanliness, honesty and fairness of the general election will reflect the quality of democracy in the country concerned. In order to protect the purity of the Regional Head Election which is very important for democracy, the legislators have made a number of fraudulent acts in the general election a crime. The crime of regional head elections must be viewed as a prohibited act that is serious in nature and must be resolved in a short time, in order to achieve the goal of making criminal provisions to protect the democratic process through regional head elections. How is the juridical study of the crime of regional head elections. How is the accountability of the perpetrator of political money criminal act in accordance with the District Court Decision Number 183/Pid.sus/2011/PN.Amt. What are the juridical barriers to accountability for the criminal acts of regional head elections? Criminal acts of regional head elections can be grouped into three based on the Law Number 12 of 2008 concerning the Second Amendment to Law Number 32 of 2004 concerning Regional Government, namely crimes relating to determining voters and fulfilling the requirements of election participants, crimes relating to campaigns, crimes involving regarding voting and voting results. Then it was concluded that the responsibility of the perpetrators of money politics in accordance with the District Court Decision Number 183/Pid.sus/2011/PN.Amt. is the defendant, Syahril Bin Atak Sani together with Paundah Als. Undah Bin Igah has been legally and convincingly proven guilty of committing a criminal act by jointly giving money to someone in order to choose a certain pair of candidates. The juridical barriers to accountability for the criminal acts of regional head elections both at the level of investigation, prosecution and examination in the court are not too heavy.
