Abstract
: Increased third-party tort liability resulting from GPS augmentation is an important issue to consider in selecting a system architecture. There are different liabilities for the U.S. Government, private and commercial parties, and foreign partnership countries. The paper explores the extent of liability by reviewing the relevant treaty, statutory, and case law. Five alternative system ownership scenarios are presented, and the impact of third-party liability is assessed for each. The conclusion reached is that the U.S. Government has significant liability exposure; however, private and commercial system owners have even higher exposure.
