Abstract
This article discusses the myths that involve the image of the judge and their main task, which is to judge, “to decide”. For this purpose, the text will refer to human mythological constructions and their relations with rites as a way to diminish human anguish and uncertainty. The discussion will focus on the image of the judge and the play “The Wasps” by the Greek author, Aristophanes, written in 422 b.C., highlighting its “mythological” importance for the debate about the present legal system.Key words: myth, rite, judge, literature, conflict resolution.

O rito é a resposta para a incerteza13, condimento da angústia do não previsível, é controle, é tanta coisa, mas é sobretudo prática social.Assim, o processo é construído em torno da lógica ritual, insubstituível por nenhuma outra linguagem, exclusivamente em função de uma coação para decidir14.Assim, nem todas as provas, mas apenas aquelas tecnologicamente mais relevantes poderiam ser admitidas, e nem todos os tempos seriam consentidos, senão dentro do código linguístico regulado pelo Direito (Resta, 2005, p. 169)
Esses mecanismos consensuais de tratamento de conflitos, entre eles – e principalmente – a mediação, precisam ter como escopo (além da celeridade processual, da proximidade entre o cidadão e a justiça, da informalidade e da diminuição de custos) principalmente o rompimento da barreira de caráter triádico da jurisdição tradicional (partes mediadas por um terceiro que impõe a decisão) para assumir uma postura dicotômica, na qual a resposta à demanda seja construída pelos próprios litigantes
Summary
Estudar o mito é uma tarefa instigadora, desafiante. Especialmente se tivermos consciência de que nosso contexto social e cultural se constituiu e instituiu a partir dele, e com ele manteve (e mantém!), no decorrer da história humana, vínculos muito próximos.
