Abstract

Creating a framework for discussion of the problem of national minorities requires the clarification of other terms explained by the public international law.Starting from the notions of state, nation, citizenship, ethnicity, national identity and national culture, we have tried to find the representation area of the “national minorities” as a term with complex meanings but still insufficiently defined by the doctrine of the public international law.We concluded by showing that despite of the lack of agreement regarding the definition of this term, “the existence of a minority is a issue of fact not of definition”.
