The objective of this contribution is to offer a general outline of the legal regulation on foreignes in Indiano law, from the official discovery of the New World to the promulgation of the Recopilación de Leyes de los Reynos de las Indias of 1680. The paper is structured around an introduction that explains the delimitations of the object of study, followed by a section that develops the legal concepts of foreigner and natural, to continue with the typology of the different rules that regulated the group of foreigners and concludes with a description of the procedure to access Castilian nature from the foreignes. Throughout the study, concepts such as ius soli, ius sanguinis, neighborhood, domicile and profession of the Catholic faith will be addressed as a logical-normative presupposition of the configuration of legal personality. These elements allow us to demonstrate that there was a royal policy to regulate and control the foreigners who participated both in the Carrera de Indias and in the social and political life of the America Indiana.
