Abstract

Th e aim of this paper is to highlight the responsibility of local government in the formulation and implementation of public policies that guarantee an environmentally sustainable urban occupation. We adopted the method of dialectical approach, in order that the work enters the world of phenomena by means of their reciprocal action and procedural structuralist method, seeing the reality of the internal point of view of the phenomena. It was concluded that local government has an important role, because it is responsible for the implementation of urban policy, fi nding bounds only in goals and guidelines of the Urban Policy, which are characterized by a content to the protective environment. Moreover, it is necessary that the municipalities act as promoter of integrating their actions with other federal entities and the population and inserting in global competition. Th e work function is to integrate the content of public policies with the urban-environmental aspects, as, planning and environmental rules, although they are oft en studied together, suff er the same problem, which is the lack of eff ectiveness, and means that this problem can be alleviated if the approach has based public policies, particularly its implementation.

Introdução

As constantes catástrofes naturais ocorridas no planeta transformaram a problemática ambiental em uma das principais preocupações da sociedade. De acordo com Corralo, após um novo esfacelamento do poder municipal a partir do século XV, “[...] como consequência da centralização operada nos regimes monárquicos [...]”, o município moderno surge tendo como marco a Lei Prussiana de 1808, que “[...] reconheceu o interesse local [...]”, conceituando a cidade para “[...] além de agente do governo estatal [...]” e reconhecia o município como “[...] uma organização para satisfazer seus interesses locais [...]”. Esse entendimento tem como base as reflexões de Rech: Dessa forma, o entendimento que deve ser feito neste artigo, em relação aos termos “cidade” ou “município”, é a observação do território local como um todo, gerido por um Governo local, que deve executar políticas públicas de planejamento que garantam uma ocupação urbana ambientalmente sustentável. E é na sua origem que devem nascer os cuidados de dotá-la imediatamente de um ordenamento jurídico, que contemple um projeto de cidade sustentável.[17]
