Abstract

The present study has been elaborated for a French reader; it contains a description and presentation of the most important issues – related to administrative law – of rules of development and use of land which are governed by provisions of the Statute on Spatial Planning and Land Development dated 27/03/2003 and of Construction Law, 7/07/1994. The issues may be connected with « town planning law », however there is no a separate branch of law dealing with town planning law in Poland.Rudimentary legal instruments regulating spatial planning in Poland at different units of the territorial structure of the State have been discussed in the paper. Spatial planning documents of the highest importance, such as those passed at the district level for local conditions studies on types of land development and spatial plans, were discussed in detail.The paper also presents a short analysis of administrative decisions made in cases of terms and conditions of land development and use; decisions which determine the way land is used and development for areas not covered by local spatial plans; also, decisions that allow construction work to be started on a plot of ground are analysed. Both legal grounds and main procedure questions of such decisions are presented. Furthermore, the question of administrative control of spatial development in cases ruled by so-called notification of construction work is discussed in the paper.
