Abstract

This study dealt with the Jurisprudential issues that consist of three parts according to Shafi’is in Al-Bayan book by Al-Omrani (dead 558 AH) in the book of Taharah and its impact on the fatwas of the contemporaries, a comparative study, because Imam Al-Omrani (may Allah have mercy on him) was an ascetic and pious Imam, a benevolent scholar, well-known for his jurisprudence and principles, speech and grammar. He was born in Yemen, and they called him the Sheikh of the Shafi’is, and the Sheikh of the people of Yemen. He mentioned in his book Al-Bayan, which is one of the important books of the Shafi’is, the most important three aspects in this book, and it is known that the aspects differ from the sayings, because these words are the words of Shafi’i (may Allah have mercy on him). There are two important sayings in this respect; that is, the old saying and the new one. While concerning the aspects, they represent the opinions of the companions of Al-Shafi’i that are based on its origins and rules. These may be their diligence sometimes not based on its origins and rules, and this is not from the doctrine, but is attributed to its owner. Therefore, the researcher selected four issues in the book of “Al- bayan” by Al-Omrani(may Allah have mercy on them) in the book of Taharah, which is related to water, and knowledge of the other sayings of the doctrine that agreed with those aspects of the Shafi’is.
