Abstract

An empirical study of the system of criminal sanctions was conducted by interviewing judges of criminal collegiums of district and regional courts of the Russian Federation, including the chairmen of district and regional (city) courts of the Russian Federation. The article presents and analyzes the results of the judges’ survey. The results obtained demonstrate the opinion of the judicial community on the system of criminal sanctions, on the compliance of sanctions with the norms of the Special part of the Criminal Code of the Russian Federation with the principles of criminal law, as well as on non-effective types of punishment, such as arrest and the death penalty. The ways of solving some problems of the system of criminal sanctions proposed by the judicial community are analyzed. The conclusions obtained have scientific novelty and practical significance, since they contribute to the improvement of criminal legislation and the development of the science of criminal law.
