Abstract The selectivity at the heart of the international legal order is not indicative of hypocrisy, but rather the consistency with which the International Criminal Justice regime operates. The international legal order has always been predicated on a state of exception and exemption. The denial of humanity and the meting out of violence against the racialized ‘other’ is central to the liberal internationalist project. Ukraine and Gaza show that the future of International Criminal Justice in fact lies in its past.
