Abstract

By incorporating an arbitration clause, contracting parties promise to refer their future disputes not to a court of law but to an arbitral tribunal that may consist of one or more arbitrators.2 The rationale behind waiving one’s right of going to court is the efficacy of the arbitral process, as it aspires to be a quicker and cheaper alternative.
