Abstract

A number of areas are considered where family violence arises in Family Court proceedings. Increasingly family violence has become a relevant factor in children's disputes, injunctions for personal protection and sole use of real property, as a consideration in property cases and in cases involving cross‐vesting of jurisdiction and damages for personal injury. Each is examined as well as the problems family violence poses for the Family Court both in terms of philosophical and historical underpinnings and in its practical application of the provisions of the Family Law Act 1975 (Cth) (FLA).
