Abstract

The essay analyzes the question concerning the union representation of employers' organizations with reference to art. 51 of Legislative Decree 81 of 2015 on collective bargaining.The author dwells on the possible implications of the system that could derive from Article 51 d. lgs. n. 81 of 2015: in fact, the failure to refer to any selective criteria regarding the representativeness of employers' organizations could generate a deregulated system, also in consideration of the steep increase in national collective agreements.In conclusion, the author underlines the need for legislative intervention to restore greater certainty to the system and to highlight the reasons of the social partners.
