Abstract

There is a firm relationship between the fatwa and the Shariah objectives, for fatwa, its function to highlight the shariah ruling regarding aspects of life in general or particular conditions that enter under the current issues. The function of the Shariah objectives is to make those rulings in the purposes of the wise legislator, and any ruling that does not mix between the fatwa and the Shariah objectives, it will produce discomfort that Allah didn't make it in his law. The research dealt with the issue of boldness of fatwas which have no the spirit of intentionality by selecting incidents that were written by the jurists in their sources to be guides for the mufti to enlighten him in a current situation that describes Islam as a religion that takes away freedom and makes its followers in distress. The process is within the limits of Islam, which judges facilitation, not rigorism, and mercy, not torment
