Abstract

The Danish tax authorities prevailed in a landmark decision from the Danish Tax Tribunal, wherein it was held that a Danish company was required to withhold Danish tax on interest paid to a Swedish parent company, irrespective of the Nordic Tax Treaty in force between Denmark and Sweden, as well as the EU Interest and Royalties Directive (2003/49/EEC).
