Abstract
In the Russian Federation, the basic principles of protecting public health are fixed at a constitutional level, and, accordingly, when providing medical care to a person, their constitutional rights are affected, which confirms the importance of the scope of circulation of medical devices. One of the main problems in providing citizens with quality and safe medical products is the imperfection of the regulatory framework in this area, including the lack of a separate federal law. The article is devoted to the problems of legal regulation in the field of circulation of medical devices. The author analyzes the level of legal regulation of the sphere of circulation of medical devices, discloses the legislative regulation of the mechanism of circulation of medical devices, and also draws attention to the existing gaps in the legislation in this area, suggests ways to solve them.

Все вышесказанное позволяет сделать следующие выводы: — необходима разработка единой государственной политики по обеспечению населения медицинскими изделиями; — не вызывает никаких сомнений необходимость принятия отдельного закона, регламентирующего обращение медицинских изделий; — на законодательном уровне необходимо закрепить положения об обеспечении прав граждан в сфере обращения медицинских изделий: каждый гражданин, а также медицинский персонал должны быть осведомлены о своих правах и обязанностях в данной сфере; на медицинскую организацию должны быть возложены соответствующие функции по предоставлению информации и необходимых документов пациенту о медицинском изделии, используемом для оказания медицинской помощи; — требуется организация специальной работы по подготовке кадров для сферы обращения медицинских изделий
Summary
На всех этапах развития общественных отношений государство подчеркивало проблему обеспечения национальной безопасности как одну из ключевых и неотъемлемых, от решения которой зависит эффективное его развитие[2]. В Российской Федерации на конституционном уровне закреплены основные начала охраны здоровья населения, и, соответственно, при оказании медицинской помощи человеку затрагиваются его конституционные права, что подтверждает значимость сферы обращения медицинских изделий[1].
