Abstract
Right is an interest or claim recognized, guaranteed and protected by the state. state is an organization which fulfills the legitimate expectation of the people. It is because of this reason the state is under an obligation to protect the rights of its people within its territory. Article 14 of the Indian Constitution ensures equality before the law and equal protection of law. The concept of equality means equality amongst the equals and not amongst the unequal‘s. Hence, when a women enters as prisoner/inmates to the prison maintained by the state (as prison is state subject in India) the state should take care of her with special attention after considering mandate under various provisions of the constitution especially under the Article 15 (3) of Indian Constitution. However, in practical the rights of the women prisoners are violating by the state authority itself. In this article an attempt is made to evaluation the various rights of women prisoners.
