Continuances and Uncertainty in the Course of Adjudication
This paper examines how uncertainties in adjudication, such as unforeseen evidence or witness issues, lead to problems like inadequate information and wasted preparation, which are mitigated by continuances. An economic calculus for granting continuances is developed to balance delay costs and benefits, with discussion of their actual use.
Abstract The myriad uncertainties common to the process of adjudication—concerning evidence that opposing parties will present, legal issues that will become relevant, illness of witnesses, and the like—lead to two social problems. First, when unanticipated events occur, the information that parties will be able to provide to courts may be inadequate. And second, preparation effort invested by parties may be wasted; whereas parties will tend to prepare for numerous possible events in adjudication, many will not come to pass and thus much effort will be for nought. Both of these problems are addressed by the granting of continuances: inability to present evidence for want of time will be directly remedied by the giving of continuances; and wasted preparation effort will be reduced because the ability to obtain continuances when uncertain events occur will lessen the need to prepare for them. But the use of continuances involves various costs of delay, meaning that the decision to grant continuances should be guided by an economic calculus. That calculus is developed in the theory presented in this article and the actual use of continuances is discussed. (JEL D8, K4, K41)

To provide a method to calculate delay cost and examine the relationship between quality and total cost. The total cost including capacity, supply and delay cost for running an interventional radiology suite was calculated. The capacity cost, consisting of labour, lease and overhead costs, was derived based on expenses per unit time. The supply cost was calculated according to actual procedural material use. The delay cost and marginal delay cost derived from queueing models was calculated based on waiting times of inpatients for their procedures. Quality improvement increased patient safety and maintained the outcome. The average daily delay costs were reduced from 1275 € to 294 €, and marginal delay costs from approximately 2000 € to 500 €, respectively. The one-time annual cost saved from the transfer of surgical to radiological procedures was approximately 130,500 €. The yearly delay cost saved was approximately 150,000 €. With increased revenue of 10,000 € in project phase 2, the yearly total cost saved was approximately 290,000 €. Optimal daily capacity of 4.2 procedures was determined. An approach for calculating delay cost toward optimal capacity allocation was presented. An overall quality improvement was achieved at reduced costs. • Improving quality in terms of safety, outcome, efficiency and timeliness reduces cost. • Mismatch of demand and capacity is detrimental to quality and cost. • Full system utilization with random demand results in long waiting periods and increased cost.

The study compared services received in substance abuse treatment programs by women who reported involvement in prostitution and by those who did not. Women (N=1,604) in a national study of substance abuse programs completed a structured interview assessing substance abuse, demographic characteristics, and past-year prostitution at program entry. At discharge, information was gathered on treatment modality (residential including inpatient, or outpatient), duration, and amounts of medical, mental health, and psychosocial services received during treatment. Analyses compared women involved in prostitution and those not involved. Women involved in prostitution were more likely to enter residential treatment. No differences between involvement groups were found in residential treatment duration, services received in residential treatment, or length of outpatient enrollment. In outpatient programs, women involved in prostitution received more psychosocial services. Substance abuse treatment programs appear responsive to the greater needs of women involved in prostitution. However, more research is needed on outcomes.

Due to the deepening of COVID-19, high-intensity social distancing has been prolonged and many social problems have been cured. In particular, physical and psychological isolation occurred due to the non-face-to-face system and a lot of damage occurred. The various social problems caused by Corona acted as severe stress for all those affected by Corona 19, and eventually acted as a factor threatening mental health such as depression. While the number of people suffering from mental illness is increasing, the actual use of mental health services is low. Therefore, it is necessary to establish a system for people suffering from mental health problems. Therefore, in this study, depression detection and emergency detection models were constructed based on sensor information using smartphones from depressed subjects and general subjects. For the detection of depression and emergencies, VAE, DAGMM, ECOD, COPOD, and LGBM algorithms were used. As a result of the study, the depression detection model had an F1 score of 0.93 and the emergency situation detection model had an F1 score of 0.99. direction.

Physicians who provide care for nursing home residents are regularly challenged by ethical and legal issues. Because nursing home care is complicated by numerous regulations and because nursing home residents have complex medical and social problems, some issues are unique to the long-term care setting and others present in unfamiliar ways. Some issues frequently encountered in this context are discussed: advance directives, competence and decision-making capacity, decisions about life-sustaining treatment, resident abuse, restraints, psychotropic medications, risk management, participation in research, and ethics committees. With knowledge of the legal and ethical framework and understanding of some of the common, complicated issues that arise, physicians should be better equipped to provide optimal care for nursing home residents.

One of the rights established by Sharia and law to protect women is Mahr. But Mahr is not one of the pillars of permanent marriage, and even a marriage without it is valid. Heavy Mahrs are one of the legal and social problems of our society. In many cases, disproportionate and unreasonable Mahrs, instead of providing financial support to the wife and the strength of the family, are used as a tool to threaten and cause anxiety in couples and as a result shake the foundation of the family to the point that it causes the phenomenon of husband abuse. Therefore, the question is whether the government can intervene in determining the amount of Mahr according to its expediency and limit and adjust it according to a commanding rule, and in order to reduce legal and social problems, prevent disproportionate and heavy Mahrs? Accordingly, in the present article, we have come to the conclusion that the government, based on expediency and necessity, can intervene in the institution of Mahr like other legal issues that have social dimensions and seek to adjust and limit the Mahr through legislation.

As the United States health care system shifts from traditional volume-based payments to value-based payments, outcomes-based contracts (OBCs) are gaining popularity among payers and manufacturers as a mechanism for the shift toward value. Under this model, stakeholders hope to align drug payment and value to real-world performance metrics (e.g., biomarkers and health care resource utilization). To understand the experiences, perceptions, and needs of payers and manufacturers related to OBCs. The Academy of Managed Care Pharmacy (AMCP) and Xcenda conducted an online survey with AMCP payer and manufacturer members. Participants were asked a series of questions regarding their use of OBCs, barriers to implementation, and elements required in establishing successful OBCs. The importance and urgency of specific impediments to successful OBC implementation were also assessed. The survey was fielded May 12, 2017, to June 7, 2017, yielding 65 responses (35 payers/30 manufacturers). While a minority of payers/manufacturers had at least 1 OBC in place (20%/33%), a majority had interest in future OBC use (71%/63%). Among those with at least 1 OBC in place, 86%/80% of payers/manufacturers had renewed at least 1 OBC in the past 5 years. All payers and 60% of manufacturers with OBCs included compliance measures. Improvement in clinical outcomes was also common (71%/70%) (e.g., reaching set laboratory values goals), and 71%/60% included avoidance of unnecessary medical resource use (e.g., hospitalization and emergency department visit). The barrier most frequently identified by payers in implementing OBCs was evidence that OBCs reduced pharmacy spending (60%), while manufacturers identified the inability to obtain accurate data/outcome measures (73%) as a major limiting factor. Payers/manufacturers endorsed the use of easily measurable outcomes (91%/100%) as most important in establishing successful OBCs. Manufacturers, and to a lesser extent payers, indicated that regulations and legal issues need to be addressed to make progress in OBC implementation (e.g., safe harbor for preapproval health care economic information [77%/46%] and exemption of OBCs for best-price requirements [83%/51%]). The only exception was the clarification of regulations for discussing information outside of an FDA-approved label, in which both manufacturers and payers indicated a very strong need (100%) to be addressed. Surveyed AMCP members are interested in OBCs and recognize their alignment to societal health goals and health care affordability, although actual use of these contracts has been somewhat limited to date. Results from this survey indicate that there is potential for OBC use to increase as barriers and limitations are addressed. The prolonged use of smartphones among adolescents, referred to as Internet addiction, is a social problem that has been discussed worldwide. Although the long-term use is regarded as an issue, actual use time has not been measured, and the discussions are not based on evidence. Moreover, the relationship between Internet use time and dependency has not been examined. Therefore, this research aimed to clarify Internet addiction from the perspective of usage time. High school students who use the Internet were selected as subjects, and their smartphone usage time and dependency were measured. According to actual measurements, their daily usage time was 4.02h. However, there was no relationship between usage time and dependency attitude. Therefore, the problem of heavy use and Internet addiction should be considered as individual policies. Specifically, for prolonged use, it is necessary to take measures to make young people aware of their unconscious behavior.

19. yüzyılın son çeyreğinde profesyonel bir meslek olarak temelleri atılan sosyal hizmet, günümüzde eski ve yeni zorluklarla mücadele ederek yoluna devam etmektedir. Yoksullukla mücadele başta olmak üzere çocuk istismarı ve çocuk koruma, ruh sağlığı, yaşlı bakımı, engellilerin rehabilitasyonu ve sağlık destek hizmetleri gibi alanlar geçmişten bugüne devam eden mücadele ve müdahale alanlarını oluşturmaktadır. Ancak bu yüzyılda iklim değişikliği, doğal afetler (erozyon, heyelan, kuraklık ve sel nedeniyle göç), küresel ısınma, yaşanabilir doğal alanların yok olması, ekilebilir tarım alanlarının tahribatını içeren ekolojik krizler mesleğin gündemine yeni mücadele ve müdahale alanlarını da dahil etmiştir. Söz konusu ekolojik kriz ve ortaya çıkardığı yapısal sorunlar birey, grup ve toplum düzeyindeki ilişkileri etkilemesi nedeniyle başta sosyal hizmet olmak üzere pek çok akademik disiplini ve mesleği de yakından ilgilendirmektedir. Öte yandan bu çalışmanın çıkış noktasında yer alan yoksulluk sorunu, sosyal hizmet alanında en sık karşılaşılan toplumsal sorunlardan biridir. Geçmişte yoksulluk sorunu ekonomik temelde ele alınırken bugün modernitenin ve küreselleşmenin de etkisiyle insani yoksulluk odağında çok boyutlu bir yapı içinde ele alınmaktadır. Bu çalışmada sosyal hizmet bakış açısıyla insan türünün bir parçası olduğu doğa ile arasındaki diyaloğa dayalı ilişkinin; tahakküm ve hiyerarşiye dayalı monolog bir yapıya dönüşmesi sonucunda oluşabilecek birey, grup ve toplum düzeyindeki sorunların neler olabileceği irdelenmektedir. Bu çalışmada ayrıca insani yoksulluk, çevresel adalet ve hak kavramları ekseninde sosyal hizmetin geçmişi, bugünü ve geleceği de ele alınıp tartışılmaktadır. Çalışmanın sonuç bölümünde bu çerçevede sosyal hizmet uzmanlarına düşen görev ve sorumluluklar da etik veya hukuki konuların ötesinde bir varoluş sorunu olarak ele alınarak ekolojik adalet ve/veya anayasa tartışmaları bağlamında değerlendirilmektedir.

The use of experimental surgery methods has a big impact on both the progress of medical treatments and the chances of people getting better results. Using new medical technology that hasn't been tried on people brings up a lot of issues related to patient safety, ethics, and the law. Laws need to be in charge of experimental surgery so that these new methods can be used in a way that is moral, safe, and cost-effective. This paper looks into how new surgery methods are handled with an eye towards the rules, morals, and legal problems that come up. The study looks into how medical rules, such as those made by the FDA and EMA, affect how new surgery tools and methods are accepted. The paper also talks about how doctors have a social duty to make sure patients give their full consent and protect their freedom, especially when it comes to novel treatments. It talks about the legal issues that have come up because of mistakes doctors made and injuries patients got during recent surgeries. It also talks about how important events in the past have changed the laws that judges have to follow. Case law, social problems, and current legal systems can all help us understand how important it is for the law to protect patient rights while also allowing medical progress. The last point makes the case for legal rules that are easy to change in order to support moral medical progress while protecting public health and maintaining faith in the healthcare system. This can help with ethical development.

With the increase of the number of same-sex people in China, the legal issues related to same-sex marriage as an important part of the national legal framework have attracted much attention. The enactment and revision of the same-sex marriage law has far-reaching significance. By studying the revision process of Taiwans same-sex marriage law and the value game behind it, this paper deeply analyzes the current situation of same-sex marriage in China and puts forward some suggestions. Across the globe, more and more countries and territories have legalized same-sex marriage. Even in China, acceptance of homosexuality is rising sharply. In this paper, some problems of discrimination against homosexuals and how to solve them are also raised. The challenges facing same-sex marriage in China also point to a lack of legal support. Therefore, the protection of homosexual crimes should be strengthened, and social problems such as sexual orientation discrimination should be prohibited.
