Abstract

The Indian concept of sexuality not only affected the rights of the class of people, in the past, but thereby affects other integral parts of legal system. This paper tends to establish the right to freedom of expression by the directors of the films depicting homo-sexuality, which are often curbed by the CBFC and the respective state governments by banning the movie. The true interpretation to the terms Censorship and Certification is misleading and thus this paper discusses the same. This paper also establishes the legality as under the test of arbitrariness of the Board and the Government while banning the movie. The democratic rights of the citizens also play a major impact of the certification to films too, which is presumed to be the crux of this paper.
