Abstract

Language rights are the most basic and the most articulated rights of persons belonging to national minorities. This chapter starts with an analysis of the current challenges for international minority rights instruments, arguing that they are facing increasing difficulties to respond to them and that Thematic Commentaries-which are more than mere compilations-are one of the most efffective ways to interpretatively adapt them to changed circumstances. Subsequently, the contents of the Commentary will be examined, describing its more relevant provisions and achievements, highlighting its main messages and pointing out the inclusive procedure followed for its adoption. Finally, the paper concludes by critically evaluating how much and to what extent the progressive interpretation of the Framework Convention is essential for keeping it a living instrument, trying to identify the next more pressing challenges for minority rights and their protection through the Framework Convention.
