Abstract

This scientific article intends to elucidate the remaining circumstances of a secular historical construction in the modern Hospitals of Custody and Psychiatric Treatment in Brazil. First of all, it will be made a contextualization about how the “madness” has already been understood around the world and, mainly, in the Brazilian territory. Posteriorly, it will be pointed the legal devices that, through the years, have ensured rights for people with mental disorders. After this, the subject matter will be delimited, starting an approach about how the inimputability has been expressed in the Brazilian Penal Codes. Lastly, it will be discoursed about the asylums’ condition in this country and about the accomplishment of these institutions while fulfilling their functions in the security measures.
