Abstract

ABSTRACT: This article proposes to analyze the textual genre of legislation, specifically the Federal Constitution of 1988, in articles 205 to 214 and to notice how the constitutional text can influence the literacy of society about the fundamental rights and guarantees that guide Private Higher Education in Brazil. The Federal Constitution of 1988 discriminates basic principles to be obeyed in educational theory and practice in different chapters, titles and articles. From the juridical point of view, these rights of the citizen only take place when they are sustained in the constitutional guarantees, having, without them, no practical validity. The right to education established in article 6 of the Federal Constitution of 1988, as a fundamental social right is detailed in Title VIII, Of the Social Order, especially in articles 205 to 214, devices that involve the realization of this right, such as the principles and objectives that inform and the duties of each entity of the Federation to the guarantee of this. How does the letter of the Law influence the line from which a plane is drawn? How can the letter of the Law influence the literacy of society about education as a fundamental right of a social nature?
