Abstract

The article is devoted to the criminal-legal characterization of complicity in a crime. From the position of the criminal law, the authors explore the criminal legal doctrine and judicial practice, unity in the understanding of the signs of aiding crime. On the basis of wide involvement of materials of judicial practice, topical and little-studied questions of the qualification of complicity are considered (the difference between aiding and abetting, the importance of classification of complicity in the physical and intellectual, the compatibility of criminal roles of accomplices, etc.). In particular, recommendations are given on the delimitation of intellectual aiding in the form of advice and instructions and incitement to a crime, depending on the nature of the advice and instructions given, and not the moment when the performer wins. The conclusion is drawn that intellectual aiding is possible either at the stage of preparation for a crime or at the stage of an unfinished attempt on a crime, while physical aiding in the form of removal of obstacles can take place both at the stage of preparation for a crime or at the stage of unfinished assassination, both and at the stage of the final attempt on the crime. When combining the functions of accomplices, it is recommended to classify the deed in accordance with each of the roles performed by the accomplice, with simultaneous reference to Parts 3, 4 and 5 of Art. 33 of the Criminal Code. The conditionality of one of the directions of the criminal legal policy is shown — the establishment in the Special Part of the Criminal Code of the Russian Federation of certain grounds for the responsibility of instigators and accomplices — the difficulties of bringing them to criminal responsibility within the institution of complicity in crime, thanks to the accessory objective and subjective nature of the latter.
