Abstract

This article explores the features of the regulation of the guarantee institution in the domestic criminal procedure legislation, which was presented by the Code of laws on the proceedings of crimes of 1832 and the Charter of criminal procedure of 1864. In the course of studying the theoretical works of domestic pre-revolutionary jurists, the above-mentioned legal monuments and other regulatory documents , the author was able to identify the patterns of development of the institution of guarantee, identify the problems of applying this preventive measure, and also establish the gaps and uncertainties of its legislative consolidation.
