Abstract

The article discusses the German model of the use of underground space. It was established that it is based on the principle of accession, according to which, as a general rule, the right of the owner of a land plot applies to underground space. At the same time, there are two types of restrictions from the general rule: civil law and public law. The author expresses the hope that some solutions of German civil law may be in demand when reforming domestic legislation on subsoil use.
