Abstract

the Ministry of the Interior of the Russian Federation, PhD (Law), Associate Professor Issues of compensation for moral damage have been the subject of scientific discussions since the early 1990s. The focus has always been on the issue of proving the level of emotional experiences, methods and forms of compensation for moral damage, and how the judge’s internal conviction is formed in resolving these issues. We substantiate that in practice, an apology is perceived as a form of compensation for moral harm and serves as a circumstance mitigating punishment by neutralizing the consequences of a criminal act, which is the reason for introducing amendments to the current legislation of Russia.
